Created in 2017, the collective bears my name fights so that children can bear the names of both parents, especially in the event of a separation. From 1 July 2022, the law finally allows parents to add their surname on their children’s identity card, as a username. While this law is essential, it is difficult to enforce and mothers often have to prove their parenting in order to look after their children, enroll them in school or go abroad.
81% of children still bear their father’s surname
In France, 81.5% of children still bear only their father’s surname. If many women adopt their husbands surname, it’s not just out of romance and a love of tradition. Not having the same name as her children is problematic. In order to access treatment, manage enrollments or even travel abroad, the “injured” parent must prove his or her family bond, sometimes without success.
A law that is still struggling to apply
From 1 July 2022, the parent who has not bequeathed their surname can now put the same name on the child’s identity card as a username. However, this law is based on the collaboration of the parental couple. The person who provided their name must be notified and in the case of joint custody both parents must present their identity document for the application of the provision. If the separation is conflicting, the “privileged” parent may then decide to drag things along, or even refuse to cooperate.
If the provision is based on a kinship pact of relative goodness, it also relies on its administrative recognition. Unfortunately, many officials are unaware of its existence and still refuse to make these changes.
To facilitate the application of this law, the founder of the collective named after me recently shared her remarks with the Keeper of the Seals. Hoping that further means will be quickly put in place.
