UPDATED with statement from Rose’s attorney: A new lawsuit accuses Guns ‘N Roses singer Axl Rose of assault and battery after an alleged assault in a Manhattan hotel suite in 1989.

Sheila Kennedy’s lawsuit alleges that she “suffered severe emotional, physical, financial and psychological distress” when Rose (real name William Bailey) “used his fame, status and power as a celebrity and recording artist in the music industry to gain access to manipulation to obtain. .” Control and violent sexual assault on her.

The suit was filed under New York’s Adult Survivors Act, which gives sexual assault plaintiffs one year to file civil claims, regardless of the statute of limitations. This window closes on Thursday.

Gutman of Gutman Law. “It is noteworthy that these fictitious claims were filed one day before the New York State filing deadline. The 10-page lawsuit filed Wednesday in New York Supreme Court (read here) named the plaintiff — a 1983 actress and model penthouse Pet of the Year – says she met Rose Kennedy in early February 1989 at a nightclub in New York. Kennedy was invited to the club by a friend who was a Guns N’ Roses fan and told Kennedy that Rose would be there. When Kennedy approached Rose’s table, the complaint says, “she immediately felt his gaze and attention turn to her.”

The singer asked Kennedy if she wanted to return to his Central Park West hotel for a party with him and Riki Rachtman, then MTV’s replacement. header, in Rose’s luxury suite. Other acquaintances of Rose and Rachtman came to the party and, the complaint states, “Rose provided his guests with cocaine, champagne and alcohol.”

Kennedy soon found himself in Rose’s bedroom in bed with Rose, Rachtman and another model. “Rose started kissing and having sex with the other model, Kennedy quickly became uncomfortable,” her suit says. “Rose was aggressive in a way that seemed painful to the model.”

Kennedy and Rachtman then left Rose’s bedroom and went into Rachtman’s room. “Suddenly,” the complaint says, “Kennedy heard objects being thrown and the sound of glass breaking.” She also heard Rose yelling at the model. … In response to the furor, Rachtman warned Kennedy: ‘It’s going to get bad’.”

The lawsuit goes on to say that Rose “grabbed Kennedy by her robe and threw her to the floor” and then “grabbed her by the hair and dragged her across the suite back to his bedroom.” She also says Rose tied her hands behind her back with pantyhose “while he was in a sexual, erratic rage.”

Rose then “sexually assaulted” Kennedy, the lawsuit says, “by forcefully penetrating Kennedy’s anus with his penis.”

“Kennedy did not agree and felt overwhelmed,” her complaint states. “She understood that the safest course of action was to stay in bed and wait for Rose to finish attacking her.”

The lawsuit also alleges bodily injury and seeks unspecified damages and a jury trial.

“Mr. Rose is confident that this case will be resolved in his favor,” Gutman added.

Rose and Guns ‘N Roses gained worldwide fame with their smash debut album in 1987 hunger for destruction, featuring rock classics such as “Welcome to the Jungle”, “Paradise City” and the number 1 pop single “Sweet Child o’ Mine”. The CD has sold over 18 million copies in the United States alone, making it one of the 14 best-selling albums in the United States.
