Elon Musk’s X loses bid to change California’s content moderation law

In September, X sued California over the repeal of its content moderation law because it violates the right to free speech under the First Amendment of the US Constitution and the California State Constitution.

Today, U.S. District Judge William Shubb denied the social media company’s motion in an eight-page decision.

The law requires major social media companies to release biannual reports on their content moderation practices. You must also provide data on the number of offensive messages and how they are responded to.

“While the reporting requirement imposes a significant compliance burden on social media companies, the requirement does not appear to be unjustified or unduly burdensome in the context of First Amendment law,” Shubb wrote.

X did not answer immediately. The company’s content moderation policy has long been controversial, dating back to before Musk bought the company.

The case is X Corp v. Bonta, U.S. District Court, Eastern District of California, no. 2:23-cv–01939.
