A criminal case was brought against him specifically for tax evasion in the amount of more than 918 million rubles and money laundering of more than 43 million rubles (in general, things are obviously bad). How long can it face?
If we take into account the amount that Elena did not pay, and the general tendency of the state to control the income of bloggers, Blinovskaya could face not only large fines and tax liability, but also a suspended penalty.
How is his situation different from that of blogger Lerchek? What is the probability of receiving a similar penalty?
Until now, events are developing similarly to the situation of the Chekalins. The composition of the charges against Blinovskaya is the same as that of Lerchek: especially large-scale tax evasion and the legalization of criminally obtained money (such money is considered money for which taxes are not paid).
To avoid paying taxes, Blinovskaya distributed the proceeds between 18 legal entities and three individual entrepreneurs. This was done in order to use the simplified tax system, in which the total amount of income should not exceed 219 million rubles. At the same time, the percentage of tax applied under such a system slightly increases when the amount of income exceeds 150 million rubles. Blinovskaya also avoided this: after the distribution, an average of 119 million revenue per organization was generated, which allowed for minimum tax payments.
So the real difference is in numbers. In the case of the Chekalins, it was about 310 million, and with Blinovskaya – already about 918 million. It turned out that the state imposed non-payment of taxes on incomes exceeding 2.5 billion rubles. Therefore, in the Blinovskaya case, a suspended sentence is more likely, and not just fines.
In principle, what punishment works under these articles: Part 2 of Art. 198 of the Criminal Code of the Russian Federation and part 4 of Art. “b”. 174.1 of the Criminal Code of the Russian Federation?
According to part 2 of Art. 198 of the Criminal Code of the Russian Federation provides for a fine from 200,000 rubles to 500,000 rubles or a fine from one to 1.5 years in the amount of the income of the accused. The same article provides for imprisonment of up to three years or forced labor, but such penalties are rarely applied in practice. According to part 4 of Art. 174.1 of the Criminal Code of the Russian Federation also provides for a fine in the amount of the income of the accused, but for a period of up to two years.
What restrictions will be imposed while the case is pending?
Blinovskaya will be banned from using the internet during the investigation. In addition, the investigation initiates checks on all legal entities and individual entrepreneurs used for the distribution of revenues.
How will this accusation affect their activities legally?
If the court gives a suspended sentence to Blinovskaya, there is a small chance that she will be banned from her current activities (selling training courses).
