Former Vice President Mike Pence has been subpoenaed by the special counsel charged with investigating former President Donald Trump.
ABC News first reported the subpoena, and the coverage was confirmed by several news outlets.
Special counsel Jack Smith, appointed in November, is investigating whether Trump or his associates mishandled classified documents and then obstructed them when the government demanded their return. Smith also reviews efforts to overturn the 2020 presidential election results.
As seen at the committee hearings on January 6, Pence resisted pressure from Trump to block the certification of electoral votes on January 6, 2021, concluding that the vice president had no authority to do so. Pence did not testify before the committee, but his aides did. Pence wrote about the events in his book published last year.
Pence is a potential presidential candidate in 2024.
At its last hearing in December, the January 6 commission recommended that the Justice Department file four criminal charges against Trump. These include obstruction of official process, conspiracy to defraud the United States, conspiracy to commit perjury, and inciting, aiding or abetting a riot. Also named for possible impeachment was John Eastman, the college professor who tried to use “fake voters” before the joint session of Congress to confirm election results.
Attorney General Merrick Garland appointed Smith as a special counsel in light of Trump’s entry into the presidential race and President Joe Biden’s intention to run for re-election. Garland later hired another special counsel, Robert Hur, to investigate the discovery of classified documents at Biden’s former office and residence in Wilmington.
