The Superior Court of Justice of Catalonia (TSJC) has decided to grant a single mother the possibility of combining the two leaves, increasing the suspension period from 16 to 32 weeks.
Currently, maternity leave is 16 weeks, as is paternity leave, and has been since 2021. In Spain, both parents are not obliged to take this leave at the same time and allow this single mother to take the two leaves consecutively it is a major step forward in terms of equity.
Indeed, according to this new decree, the text of which can be consulted (in Spanish), “the mother can extend the suspension of the contract and the duration of the allowance, accumulating the 16 weeks that would correspond to the other parent if there were one, in order not to give the minor child unfavorable treatment depending on the family model to which he belongs . »
According to the National Institute of Statistics in Spain, for the year 2020, 81% of single parent families are headed by a woman.
