Alec Baldwin seeks Halyna Hutchins’ parents, sister’s lawsuit over death of ‘Rust’ cinematographer

Alec Baldwin is not appearing at the New Mexico mini-trial next month in the fatal shooting of Halyna Hutchins, and he doesn’t believe he should be a defendant in the trial of the slain man’s parents and sister rust Cameraman in Los Angeles.

Baldwin Quinn Emanuel Urquhart & Sullivan’s defense team, acknowledging the horror of the shooting in October 2021 and the fact that “there is no doubt the loss of a daughter and sister is painful in any circumstances,” claims Ukrainians Olga Solovey, Anatoly Androsvych and Svetlana Zemko “dissociated physically, financially and emotionally from Halyna years before her death” and “has no valid reason to act against defendants” (read it here).

The appeal, filed April 13 by the indie western star/EP and El Dorado Picture, continues the February 9 statement of negligence and accusation by Hutchins’ parents and sister:

This action is particularly out of place. The parties’ stay and the compensatory nature of a consortium’s loss claim support the application of California law. And in California, marriage between the claimant and the decedent is an essential element of withdrawal. None of the plaintiffs can argue or prove any such relationship with Halyna Hutchins. And even if the laws of New Mexico were to apply, plaintiffs’ lawsuit would still fail because plaintiffs’ lawsuit contains nothing more than a single conclusion that a sufficiently close relationship, no matter how many times it is repeated, is not established by the law is characterized not be supported. , as required by New Mexico law, to make claims for loss of consortium.

Baldwin and his team have already faced criminal charges in the Land of Enchantment that could see him behind bars for 18 months.

Along with Baldwin several rust Manufacturers, gun maker Hannah Gutierrez-Reed and 1St Assistant director David Halls is one of the defendants in the California case, represented by Gloria Allred’s Solovey, Androsvych and Zemko. The high-profile Allred is also one of the legal representatives rust Screenwriter Maime Mitchell in her November 2021 negligence lawsuit against Baldwin, rust manufacturers and others.

Today, Allred was surgical in her denial of Baldwin’s final request.

“We are not surprised that Alec Baldwin is again trying to avoid responsibility for what he did,” the lawyer told Deadline this evening. Under New Mexico law, which will apply in a California court, it is clear that he is responsible for all the damage he caused to Halyna Hutchins’ entire family. We are here to make sure he is held accountable for his actions.”

With a two-week preliminary investigation, a so-called mini-trial, beginning May 3 in Santa Fe, Baldwin may know as early as mid-July in LA whether the tumultuous New Mexico case against him and Reed will even go to trial. Faced with a list of witnesses from Hutchins’ widower, Rust director Joel Souza, several officers and more, both Baldwin and Reed pleaded not guilty. Santa Fe District Attorney Mary Carmack-Altwies, who faces a series of legal faceplants, dropped the case on March 29 and appointed New Mexico attorneys Kari Morrissey and Jason Lewis as special prosecutors.

It was just the latest in a series of missteps that have marked the pursuit of the tragedy since the start of the year.

In a media frenzy more than a year after Hutchins was killed on October 21, 2021 rust finally, on January 31, the district attorney filed involuntary manslaughter charges against Baldwin and Reed.

Despite all the civil lawsuits filed against Baldwin in New Mexico and other jurisdictions, the prosecutors’ strong position did not last long.

On Feb. 20, Carmack-Altwies dropped a gun upgrade that would have carried a five-year sentence after defense attorneys claimed it was “unconstitutional.” Then, with the slings and arrows of campaign hijacking and more unconstitutionality, there was the March 14 resignation of the beleaguered former special attorney and current New Mexico GOP Rep. Andrea Reeb. That, and the early hearing loss before Judge Mary Marlow Sommer, made the prosecution the Keystone Cops.

With the Santa Fe mini-trial looming and the new duo of special prosecutors assuming their roles, Baldwin was granted a waiver by Judge Sommer on April 10 not to appear at the preliminary hearing. After Morrissey and Lewis present the evidence in the case, Judge Sommer will decide whether there is enough to go to court later this year – a big if at this point.

Not that the Santa Fe role wasn’t already taken.

There will be a hearing next week to finalize the settlement of the wrongful death lawsuit against Matthew Hutchins with the producers of Baldwin and Rust. The largely confidential agreement was first announced in October 2022, and the April 17 hearing appeared to be focused on protecting the privacy of Hutchins’ young son Andros.

To further muddy the murky waters of Rust , a revived version of the low-budget film is said to begin production in Montana on April 20, Deadline exclusively reported on March 16. Along with a separate documentary on the life and career of Halyna Hutcins, Dat rust 2.0 stars Baldwin will once again be directed by Souza, who was injured during filming in 2021, and will have Matthew Hutchins as executive producer.

Despite an FBI report released last summer and the Santa Fe Sheriff’s final word in November 2022 about his October 2021 investigation into what happened at Bonanza Creek Ranch, Baldwin remains adamant he won’t let the 1880s prop cannon be pressed which killed Hutchins and. wounded Souza during a rust Example.
