The Montana House of Representatives today passed legislation that would ban the streaming app TikTok. It now goes to Republican Governor Greg Gianforte to sign into law.
If approved, Montana would be the first state to ban TikTok downloads. Lawmakers and critics of the streaming service fear the Chinese government could be hoarding US user data. This could potentially enable them to launch disinformation campaigns or otherwise manipulate users.
Under Montana law, it would be illegal to allow TikTok downloads in the state. Violators face a fine of $10,000 per day. App stores like Apple and Google will be vulnerable, as will the TikTok page itself. It is unclear what the outcome will be for those who already have the app on their devices.
Each new law would take effect in January 2024. The timing will allow TikTok to appeal in federal court.
The Biden administration continues to negotiate with the company about a divestment from its parent company in Beijing. Congress is also working on a bill that would give the Commerce Department the power to ban apps run by “foreign adversaries.”
