The Dorogomilovsky District Court of Moscow received claims against Smart Retail LLC (Samokat brand) and Local Kitchen LLC (Kitchen in the Region brand) “for compensation for moral damage related to harm to life and health.” The appeal concerns mass poisonings caused by beans added to salads sold at District Kitchen and Samokat.
“In this case, we quickly received a refusal from the defendant to meet our demands at the preliminary hearing stage, so the case was filed as one of the first cases,” Boris Feldman, representing the victims’ interests, told RBC. According to him, the amount of the claims ranges from 250 thousand to 2 million rubles. He explained that the size of the claims is influenced by the subjective assessment of the victims themselves regarding their “moral and physical suffering.”
The defense focuses on collecting fines from companies involved in the distribution of low-quality products. If the court grants the plaintiffs’ demands, the defendant will have to pay 50% of the amount awarded in its favor.
Let us recall that in the summer there was a major botulism epidemic in Russia. Then the Lyublinsky District Court of Moscow satisfied the demands of Rospotrebnadzor and suspended the work of LokalKitchen LLC (“Kitchens in the District”), whose beans were consumed by patients, for 90 days.
The head of Rospotrebnadzor, Anna Popova, called the official cause of the poisoning a violation of all rules and technologies for preparing bean salad. The head of the department announced that 417 people in 11 regions of the country were infected with botulism, two of them died.
