Defense asks Harvey Weinstein not to be returned to prison before trial

Harvey Weinstein’s lawyers want him to remain at Bellevue Hospital until November. The producer underwent emergency heart surgery.

Weinstein’s representatives are confident he should not return to Rikers Island until his retrial. “There is no trial or specific charges at this time,” Weinstein’s representative Judah Engelmayer told People. “We expect to keep him in Bellevue for the duration of his incarceration.”

Until last Sunday, Harvey Weinstein was being held in the Rikers Island prison hospital. He was taken there in July of this year. Weinstein has contracted Covid once again and has several other chronic diseases.

Recall that Harvey Weinstein was sentenced to 23 years in prison in 2020 for two crimes: rape in 2013 and forced oral sex in 2006. Later, in February 2023, he was sentenced to another 16 years in prison for raping actress Jane Doe. Therefore, despite the review of the case, the producer remains in custody. The sentence was overturned in the spring.

Prosecutors for producer Harvey Weinstein are ready to defend their position to the hilt. The date for a new trial was announced Wednesday. A Manhattan judge said a new hearing in the celebrity case will be held in early September.
