Dying with dignity, but under certain conditions. The “end of life” bill was presented to the Council of Ministers on Wednesday 10 April and the main lines of this law – which is expected to be debated in the National Assembly at the end of May – were revealed.
This help to die” consists of the administration of a lethal substance, carried out by the person himself or, when he is physically unable to do so, by a doctor, a nurse or a volunteer designated by him”we can read in the text of the law.
Five strict conditions to meet
But to access it several conditions must be met, five in total: The patient must be greaterhave the French nationality or legally reside in France, be “ able to express their will in a free and informed way »To be suffering from a serious and incurable disease jeopardizing its vital prognosis in the short or medium term, and it must “ present refractory or unbearable physical or psychological suffering related to this condition ».
The patient can request it from a doctor, and only from a doctor. The latter must also consult at least one other professional, “those who do not know the person are specialists in their pathology if they are not one themselves”it’s at “paramedic healthcare professional”if possible in relation to the patient.
The first doctor contacted then makes the decision himself, after a fifteen day reflection period. The patient must therefore “reaffirm one’s will” after two days of reflection minimum. The doctor then prescribes a “lethal substance”. The patient will be “accompanied” by a doctor or nurse in this process, even if he or she administers the product yourself.
Any caregiver can refuse a patient’s request for assistance in dying. In this case, the patient can challenge this decision, “before the administrative court”, according to the invoice. According to experts, this text can last up to two years before being definitively voted.
