Good news ? A bill to constitutionalize abortion presented this week to the Council of State, according to Emmanuel Macron

The Head of State promises that “women’s freedom to resort to abortion will be irreversible” by 2024.

He promised it on March 8, on the occasion of International Women’s Rights Day. Emmanuel Macron announced a constitutional bill on his social networks on Sunday 29 October “We write women’s freedom of appeal into our Constitution abortion [interruption volontaire de grossesse] » would have been sent this week to the Council of State. The text will then be “presented to the Council of Ministers by the end of the year”which means that“in 2024, women’s freedom to resort to abortion will be irreversible” added the Head of State.

Law or freedom?

For International Women’s Rights Day, March 8, 2023, Emmanuel Macron therefore promised to constitutionalize “ women’s freedom » resort to abortion, a year and a half after the repeal of the US ruling Roe v. Wading. The latter has been guaranteeing abortion on the territory of our transatlantic neighbors for 70 years.

A semantic choice that is far from unanimous among left-wing and feminist activists: “ freedom means leaving the choice to the law to decide » Mathilde Philip-Gay, professor of law at the Jean Moulin Lyon 3 University, had analyzed for Madmoizelle, fearing a symbolic measure without real legal protection of this fundamental right.

Today this right is recognized by common law

Currently the right to abortion is recognized by ordinary law. Its constitutionalization would complicate any attempt by the legislature to suppress this right or seriously weaken it.

As remembered AFPEmmanuel Macron reiterated, at the beginning of October, his desire to change the situation: “I expressed the hope, on March 8, that a text could be found that would reconcile the points of view between the National Assembly and the Senate and allow the convening of a Congress in VersaillesS. I hope that this work of gathering points of view will resume and conclude as soon as possible. »

In Publicationseveral left-wing feminist exponents have welcomed this new progress promised by the Head of State, which they attribute to long-term work: “This is the result of the continuous pressure we put into this fight” entrust Mélanie Vogel to our colleagues.

But caution remains a must: “We feared that the constitutionalization of abortion would be included in a comprehensive constitutional bill which, in our eyes, would have complicated its adoption », adds environmentalist MP Marie-Charlotte Garin in the columns of Publication. “Now, pay attention to the ad effect. Now we are waiting for concrete results and a timetable. »
