Pro-Palestine demonstrations are no longer systematically banned

On Wednesday 18 October, the Council of State decided to revoke the systematic ban on pro-Palestinian demonstrations on French soil, implemented by Gérald Darmanin. The decision will now be made by the prefects, on a case-by-case basis.

A setback for Gerard Darmanin. While on 12 October the Minister of the Interior had banned all demonstrations in support of the Palestinian cause organized on French soil, on Wednesday 18 October the Council of State relaxed this ban. Now they will be prohibited at the sole discretion of the prefects, and not of the minister.

This is what the prefects will decide ” case by case “, whether the risk of disturbing public order justifies a ban on demonstrations in favor of Palestine. Initially it was by telegram that instructions were given to the prefects to ban everyone “pro-Palestinian demonstrations”, Why “risk of disturbing public order”.

But in its decision the Council of State underlines it“no ban can be based solely on this telegram” OR “for the sole fact that the demonstration aims to support the Palestinian population”he adds in a press release.

A ban that was strongly denounced by Amnesty International. Jean-Claude Samouillerpresident of the organization, said in a press release: “ The ban in France on any demonstration in support of the Palestinians constitutes a serious and disproportionate attack on the right to demonstrate. (…) According to international law, a ban on demonstrations can only be considered as a last resort. Authorities should always seek to protect and facilitate the rights to freedom of expression and peaceful assembly first and foremost. »
