A female executive who sees herself as a victim of pay inequality was able to ask the courts to produce her male colleagues’ pay stubs to prove it.
This is a case that could serve as a step forward in demonstrating wage inequalities in companies. It all starts in July 2017, as noted by l‘AEF AND franceinfo. An employee of the Exane group was named director of strategy and projects for the group, but was fired two years later.
Believing that she has experienced pay discrimination compared to her male colleagues, seizes the labor court and asks for the slips of her former colleagues to prove the inequalities of which she was a victim.
The case will first go to appeal, then arrive before the Supreme Court on March 8, the company refused to provide him with the pay stubs of its employees. Their reason? They believe this is an invasion of privacy. Furthermore, they suggested other means to the plaintiff of proving wage inequalities, such as the gender parity index in the group, which would not necessarily be reliable.

This will not be the opinion of the Court of Cassation because the judges believe that to benefit from an impartial judgment, the complainant must have access to all the pay slips of her former male colleagues, records that will not be anonymised.
According to the Court of Cassation, if this affects the personal life of the interested parties, such action is indispensable for the exercise of the right to proof. Thus, eight employees in positions of a comparable level to that of the complainant will have their payslips analyzed during the trial.
