The femicide of Chahinez Daoud: the victim’s family attacks the state for gross negligence

On Friday March 10, the lawyer for the parents of Chahinez Daoud, who was murdered by her spouse in 2021 in Mérignac, announced that she had initiated proceedings for gross negligence against the state.

The case dates back to May 2021. Chahinez Daoud, 31, mother of three, was burned alive in the middle of the road by her husband. Ten months before her, the latter was convicted of domestic violence and she continued to harass her. Chahinez had filed charges twice, without success.

Far from being an isolated case, the femicide of Chahinez Daoud has once again revealed the shortcomings of a justice system that fails to protect victims of violence: it is estimated that out of 210,000 women victims of domestic violence, only 33,000 perpetrators are subjected of legal actions.

On Friday March 10, the lawyer for the parents of Chahinez Daoud, Me Julien Plouton, therefore announced that France Blue Gironde that he would initiate gross negligence proceedings against the state. In question, a series of malfunctions in the public service of justice that played a decisive role in the assassination of Chahinez Daoud.

One year “errors, appalling failures and cumulative negligence »

While her husband is in jail after being accused of domestic violence, he calls the young woman 36 times, saying he will return to the couple’s home. Chahinez Daoud filed a complaint for the first time, but the execution judge was not informed.

A short time later, the man was released from prison, without Chahinez Daoud being informed. It will only take three months for the victim to be attacked by her ex-spouse on March 15, 2021 when leaving a supermarket. He files a new complaint. The next day, he called the police, who issued a search form. No way: the man doesn’t question himself and continues to walk freely in nature. He even confided in his probation officer that he reconnected with Chahinez.

How did we get to this? Would Chahinez Daoud still be alive if justice had done its job? The lawyer of the victim’s family denounces ten months ” mistakes, appalling failures and cumulative negligence “.

A symbolic process

After the femicide of Chahinez Daoud, the government had promised new measures against gender-based violence. Two years later, however, the figures remain unchanged, as evidenced by (among others) the number of femicides recorded by We All since the beginning of the year or the latest report by the High Council for Equality on the state of sexism. .

Just last week a woman from the Gironde was killed by her ex-spouse, against whom she had filed two complaints. The man had not been followed up since his release from prison in 2017.

We have not yet succeeded in curbing this phenomenon. “, Julien Plouton regrets to our colleagues of Blue France. Underlining the appalling shortcomings of the public justice system, he is asking the state for one million euros in compensation for the parents of Chahinez Daoud. A mainly symbolic approach: “Despite the efforts made by the government, despite the allocations in terms of equipment, there is still a lot of work to be done, particularly in terms of raising awareness of the investigative services, on the responsiveness that must be had in this genre. of the folder “.

When will the state assume its responsibilities? While the government reaffirmed its intention to make the fight against violence against women a five-year priority on Wednesday 8 March, the measures presented by Prime Minister Élisabeth Borne as part of the 2027 Plan for Gender Equality still ring true (too) hollow .
