Why Alec Baldwin May Be Having a ‘Tough’ Time Defeating Manslaughter Charges: Lawyer Explains (Exclusive)

Alec Baldwin64. He was criminally charged with two counts of manslaughter in the shooting of Oxide movie, halyna hutchins, in New Mexico on October 21, 2021. New Mexico’s first District Attorney Mary Carmack-Altwies released the shocking allegations in a press release today, more than a year after the deadly shooting. The statement indicated that for the first charge, the sentence would include 18 months in prison with an additional $5,000 fine. However, according to the prosecutor’s statement, the second charge against Alec carries a mandatory sentence of five years in prison. hollywood life spoke to the criminal defense and appellate attorney, Matthew Baroma, founder of Barhoma Law and Power Trial Lawyers, who told us in an EXCLUSIVE interview why Alec’s decision to speak out this past year could really affect his chances of defeating these allegations.

“Alec Baldwin really thought he wasn’t going to be charged,” Barhoma said. “He was giving us a reiteration of how the law works, piecing together his own statements and home videos. These things could never help you. They can only hurt you,” said Attorney Barhoma, who doesn’t work with Alec but knows New Mexico law. “They can only be brought in to hurt you. That’s how the evidence code works. learn pretty quickly the repercussions of being so loud while under investigation”.

As reported, Halyna was shot and killed at the age of 42 on the set of Oxide by a projectile fired from a propeller gun. director Joel Sozza he too was injured after the crash, but survived. The gunsmith from the movie, Hannah Gutiérrez-Reed — whose duties reportedly included making sure the gun did not contain live bullets — was also charged. The assistant director of the film, david salthe reached a plea deal and received a misdemeanor charge for negligent use of a deadly weapon.

HL: Do you think the allegations against Alec Baldwin were fair? Why or why not?

ATTORNEY BARHOMA: I think those are the correct allegations. I think the prosecution was smart and made the correct allegations. The last thing you want is an overzealous accusation. Manslaughter is about manslaughter. The fact that we’re looking into the manslaughter charges makes a lot of sense. :

HL: Alec’s lawyers are confident they will win the case. Do you agree?

ATTORNEY BARHOMA: I think I can present a plausible defense. The problem with him though will be all the notoriety he gained afterward. He made various statements, including mentioning that he pulled the trigger. This will be a sticking point now for him. Another factor will be your kindness. I think your credibility and kindness are out the window. It was a little broken. Defense-wise, they will have to rebuild a lot. And that can be difficult.

HL: Do you think the accused gunsmith will take a plea deal?

ATTORNEY BARHOMA: It’s possible. You never know when a settlement will occur and what the terms of that settlement will be. The New Mexico District Attorney can strengthen his case simply by arguing that everyone comes forward and has them testify against Baldwin. I mean, they already have one. Yes, I just need one more.

HL: How long before this goes to trial?

ATTORNEY BARHOMA: This is an ongoing investigation, so I have no reason to believe there won’t be a speedy trial. The prosecution brought the right kind of charges. They are adamant in your case. And if they get the other plea, they’ll speed things up even more. I think I’ll probably hear a verdict in a case like this before the year is out.

HL: Would it be wise for Alec to take a stand?

ATTORNEY BARHOMA: If this was a self-defense case, I really would need to testify, but it’s all malpractice. I don’t think there are any allegations that he could have been negligent, so I think taking the position himself might not be the best course of action for him.

HL: Will you be allowed to work during this process? How about traveling?

ATTORNEY BARHOMA: This depends on the terms of your bonus. There will be a bail hearing that will take place. I think it will be good for traveling and working. He clearly had a lack of purpose. This is not like a criminal act in which he sought murder. With your lack of intentionality, the bond will be quite forgiving.

HL: If I could give a percentage chance that Alec will be found guilty. Based on your experience, what percentage would you say?

ATTORNEY BARHOMA: Can’t comment on that. But I think the prosecution has been smart to bring the right charges and that makes things much more difficult for him.

HL: How much jail time will you face if convicted and convicted?

ATTORNEY BARHOMA: This is a manslaughter charge. It is one of the lower degrees of homicide. And there is no intentional factor. When we think about punishment and how to punish a defendant, we look at his degree of intentionality, and here it doesn’t exist.
