A bill that would limit employers’ use of non-disclosure agreements to silence victims of sexual harassment overwhelmingly passed the House of Representatives on Wednesday and will now go before President Joe Biden for signature.
The legislation comes a step further on a law Biden signed earlier this year that ended forced arbitration in such cases. The president is expected to sign the new law.
The House of Representatives passed the Speak Out Act by a vote of 315 to 109. Former Fox News personalities Gretchen Carlson and Julie Roginsky defended the legislation.
The law only applies to cases before a dispute arises, not after, and does not cover other workplace misconduct such as: B. Discrimination on the basis of age and race. The bill also would not apply to NDAs signed in sexual harassment settlements, such as the kind Carlson and Roginsky signed in their cases. Instead, the legislation covers the types of “enforceable” nondisclosure agreements employees face as conditions of employment.
