What is the proposed transphobic law on children in France?

On May 28, 2024, the Senate is studying a bill on transphobia proposed by Jacqueline Eustache-Brinio (Les Républicains). For Madmoizelle, trans psychologist Morgan Noam, author of This Is Not a Book on Gender, sheds light on why this is a matter of life and death for many trans and/or questioning children.

You may have heard of the transphobic book Transmaniaco-written by TERF (feminist pseudonyms that exclude trans people).

What is this bill against the gender transition of minors?

His release is part of a climate of growing transphobia that is trying to make its way into the law in France. On May 28, 2024, the Senate examined a bill proposed by Senator Jacqueline Eustache-Brinio, belonging to the Les Républicains party. Her goal is prohibit any type of medical transition for minors.

Calls for legal oversight much more severe regarding the prescription of puberty blockers or hormones before the age of 18, but also the practice of surgical procedures. This bill could pass because the Senate is predominantly right-wing. But Concretely, why does the fate of trans children cause such moral panic in France?

Why is there so much moral panic about trans children in France?

What it was against the inclusion of abortion in the Constitution is based on the conclusions of a working group formed more than a year ago on “transidentifications of minors”. Among the 67 testimonials in this report, we can see that very few of them really know the topic. We asked psychologist Morgane Noam, author of the book This is not a book about gender to explain the role of puberty blockers.

“It’s simply a treatment that allows you to pause puberty. This does not stop puberty. It puts it on hold until the child grows up and can make the decision whether or not to begin a transition. And it’s sudden a completely reversible treatment. This decision, of course, is up to the doctor, but it is also up to the family. You should know thatTo access this type of processing, the consent of both legal representatives is required. »

Much misconception and misinformation surrounds the treatment of trans children

In fact, very few underage transgender youth have access to puberty blockers. Not only because it is already very difficult to obtain, contrary to what the right and far right suggest. But also because so many young people I don’t feel the need resort to this treatment.

If the law were ever passed, a doctor accompanying these kids would risk up to a maximum two years imprisonment and a fine of up to 30,000 euros.

At Les Républicains, at the National Rally or at the Reconquest, everyone is afraid of children" succumb " to this " new fashion » which would be trans. But, spoiler, you don't become trans through social pressure, concluded a large-scale study, conducted on 91,937 adolescents in 2017 and 105,437 in 2019.

Detransitions concern just 0.4% of cases

Even the right and the far right have as their strong point the “young transitioners”. However, as quoted by expert Tal Madesta, in his essay The end of the monstersdetransitions are extremely rare: 0.4% according to one of the most pessimistic meta-studies on the subject which followed 27,000 people.

This figure is sometimes inflated by exploitation of the media and policies that take into account pauses in the transition of some trans people. A break due to transphobia which harms their material conditions and prevents them from living life as they wish (family rejection, difficulty finding housing, a job, etc.). This is what was explained to to miss the journalist specializing in transience issues:

“When we really look at the detransition numbers, we realize it what makes our life journeys difficult is not being trans per se, but transphobia. These are just exogenous factors. The media uses detransition data to suggest that we are weather vanes, when transition is extremely difficult. Everything tries to dissuade us. And sometimes trans people take a break from their journey before picking it up again later. »

What about reassignment surgeries for transgender children?

In addition to puberty blockers (with perfectly reversible effects), reassignment surgeries are also targeted by this transphobic law. However, contrary to popular belief, trans minors in France cannot have vaginoplasties or orchiectomies.. On the other hand, Torsoplasty/mammectomy can be performed, but extremely rare, only from the age of 16 and always with parental consent.

Jacqueline Eustache-Brinio's transphobic bill also wants to put an end to the 2021 Blanquer circular, which has been criticized since its introduction. However, it makes it possible to promote the school integration of transgender minors or those who question their gender identity, promoting social transition.

Trans people are 8 times more likely to attempt suicide than the average cis person

This transphobia bill also aims to circumvent the law banning gender identity-related conversion therapy among trans youth. However, remember, trans people are 8 times more likely than cisgender people to attempt suicide due to transphobia to miss psychologist Morgan Noam:

“You should know that it has nothing to do with their identity. It's not because they are gay, bisexual, trans, but absolutely everything that has to do with them the transphobic climate in which they evolve. »

Between 30 and 50% of trans people have attempted suicide. In other words, being able to delay puberty, or even start one Social transition is a matter of life and death for many trans youth. This is why the transphobic bill could cause chaos in France.
