This is the first victory for defenders of LGBTQI+ rights in Italy. While attacks against the rights of same-sex families have multiplied since the election of far-right Prime Minister Giorgia Meloni, on Tuesday 5 March the court in Padua, in the Veneto region, decided that children can have two mothers listed on their certificate of birth.

The Court of Padua recognizes social mothers on the birth certificates of children from same-sex families
With this decision he rejected a request made in 2023, who asked municipal authorities to remove the names of non-biological mothers from birth certificates, this for thirty-seven children born between 2017 and the start of the procedure. If the prosecution’s request had been granted, the non-biological mothers they could have lost all rights to the child in the event of the death of the second parent or separation.
A lesbophobic offensive
Although same-sex civil unions became legal in Italy in 2016, Italian law remains unclear on parental rights in same-sex families. Over the years, the Italian Supreme Court has repeatedly invited Parliament to clarify this situation, without starting a legislative procedure.
Thus, thanks to several court decisions, in recent years many mayors have agreed to register biological parents as non-biological on birth certificates.

But in January 2023, the Interior Minister of Giorgia Meloni’s ultra-conservative government ordered municipalities to no longer transcribe the birth certificates of children born abroad for surrogate mothers, a practice banned in Italy.
A ruling has prompted many prosecutors to question the birth certificates of gay couples’ children, whether they come from surrogate mothers or not. In March 2023 the Milan Prosecutor’s Office had even enlarged this request to children conceived through surrogacy by female couples.
