Policeman released after insulting a woman victim of sexual violence

The young woman had come to file a complaint of sexual assault. A few hours later, she had the pleasure of discovering a message accidentally left on her answering machine in which the policeman repeatedly called her a “whore.”

It seems like a bad joke. A police officer, who was gone ” For error “ a message on the answering machine of a complainant who came to file a complaint of sexual assault, and in which he called her “whore” on several occasions he was acquitted. The police court ruled that these insults did not constitute “Non-public insult based on sex”.

Facts dating back to 2022

On the night between 4 and 5 February 2022, a 34-year-old woman went to police station 5And and 6And neighborhoods of Paris to file a complaint “Drunk sexual assault”. Another police officer from the same police station then called her back and left her a message asking her to come and complete her report. Thinking she had hung up on her, she then commented to colleagues: «I’ll call you back anyway because you must be having some problems right now. » Reading aloud an excerpt from the complaint, he then stated: “She really is a whore. (…) Damn, he refuses to face the bitch. As if by chance. It was actually just to bust his balls, I’m sure. (…) Damn, you big bitch. »

The message was made public by Mediapart.

Four months suspension

If these insults had been brought to the attention of his colleagues, this would have constituted “a non-public insult based on sex”or for himself,” like when you get angry with a cyclist in the car ”, as the policeman claimed?

During the hearing in early December, the prosecution ordered the court to answer this question “ in his soul and conscience “. As reported by AFP, the prosecution had suggested that, in the first case, the police officer should be convicted but exempted from punishment, given his exemplary career, and that in the second case he should be released. The young woman then said to feel “ crushed “.

This case has once again highlighted the failures in police treatment of victims of sexual violence. First threatened with dismissal by the Minister of the Interior, the policeman was finally suspended for four months, before being sanctioned with professional transfer, then in June 2023 with a ban on contact with victims and defendants. At the December hearing he denied being “ sexist or misogynist » and he said to himself “Very sorry that the victim heard these unpleasant comments “.

Reacting to the police court verdict, the plaintiff’s lawyer announced that his client intended to appeal. “The president of the police court found that a police officer’s calling a sexually assaulted woman ‘fat whore’ did not constitute a sexist insult”he was indignant towards Agence France-Presse. “The judicial institution continues to protect the police. My client wishes to appeal to change judicial practice. »
