Federal judge says Donald Trump raped E. Jean Carroll

Although he was convicted of sexually assaulting the journalist last May, the jury rejected the rape charge.

On May 9, a New York civil court jury declared Donald Trump perpetrator of sexual assault against the reporter E. Jean Caroll. But although the former US president was ordered to pay him $5 million in damages, the jury still dismissed the rape charge.

But this Wednesday, July 19, the federal judge Lewis A. Kaplan, turned. While Donald Trump wanted to file a lawsuit against the journalist for libel, this judge issued, in a 59-page decision, an opinion stating that the former US president had indeed assaulted E. John Carroll. According to him, it’s not because the assault didn’t fit the definition of rape under New York law that he didn’t violate it.

As a result, Trump was denied a retrial in the case, this time for defamation of the reporter, although his appeal is still pending.

Judge says evidence against Trump is ‘compelling’

As the evidence at trial clearly shows, the jury found that Mr. Trump had indeed done exactly as described », Judge Kaplan wrote in his note. According to him, the colossal sum of damages owed to him does not come out of nowhere:

This jury did not award Ms. Carroll more than $2 million for fondling her breasts through her clothing, reprehensible as that might be. There was no evidence of such behavior. Instead, the evidence convincingly established, and the jury found by implication, that Mr. Trump deliberately and forcibly penetrated Ms. Carroll’s vagina with her fingers, causing immediate pain and long-lasting emotional and psychological damage.
