The hope will have been short-lived. A senatorial report on the health of women at work, published on Wednesday 28 June 2023, rules out the possibility of applying the Spanish model of menstrual leave for people with painful periods in France. However, the senators advocated adding endometriosis to the list of long-term conditions.
The Spanish model has not received acclaim
Last February, Spain led the way in the matter, adopting a law providing for the institution of menstrual leave for people with disabling periods, due in particular to pathologies such as endometriosis. This leave is granted by a doctor through Social Security funded sick leave.
In their report, Laurence Cohen (PCF), Annick Jacquemet (UDI), Marie-Pierre Richer (LR) and Laurence Rossignol (PS) detail their divergent conclusions: the first three believe that ” the establishment of a large device for painful menstruation is not justified if there is no disabling pathology”. According to them, ” for this type of pathology the answer lies in the real therapeutic cure rather than in the implementation of the leave we can read in the report.
Senator PS, on the other hand, believes ” that this leave, within the limits that would be defined by law, responds to a global issue of the visibility of women at work and professional equality “. But, in the absence of consent, the option was abandoned.
Take better account of endometriosis
As specified AFP extensionhowever, the four panelists agreed on the need to recognize endometriosis as a long-term condition (ALD 30). This would eliminate the waiting period associated with sick leave, and thus the resulting financial losses.
This proposal is one of 23 recommendations issued by the Senate report around three axes, recalled by our colleagues in the Parisian : “ adopt a gender approach to occupational health; develop and adapt prevention for women; take greater account of sexual and reproductive health at work “.
Today, in France, endometriosis affects between 1.5 and 2.5 million people.
