Unanimously, Parliament passed the very first law regulating the practices of influencers

The deputies and then the senators unanimously adopted a bill that prohibits the promotion of certain products offered by influencers.

This is a rare consensus. On Thursday 1 June, the Senate unanimously adopted a bill to better regulate the influencer sector, which has been under fire for several years, in particular due to abuses. On Wednesday 31 May it had already been voted, again unanimously, by the deputies of the National Assembly.

The text prohibits influencers from promoting certain products or certain unsafe practices. First of all, it poses a legal definition of this profession, which is still under construction. Therefore, influencers are people who, for compensation or benefits in kind, “mobilize their notoriety with their audience to communicate” on line “content intended to promote, directly or indirectly, goods, services or any cause”.

This bill contains several prohibitions. For example, influencers will no longer be able to promote certain practices, such as cosmetic surgery, and formally ban the promotion of several medical devices. It also prohibits the promotion of products containing nicotine, and calls for submission to the Evin Act, which prohibits any promotion of alcohol. The text also attacks the promotion of sports betting and gambling.

Prison sentences

The bill also prohibits setups with animals. And when promotional images, for example for cosmetics, are retouched using a filter, this should always be mentioned. If all these measures are not respected, the penalties foreseen in case of non-compliance can rise to two years’ imprisonment and a fine of 300,000 euros.
