Steven Tyler is seeking to dismiss a lawsuit filed in December by a woman who claims the Aerosmith frontman had an illicit affair with her when she was 16 and he was 25, saying their claims are fully or partially excluded by the approval of their share.

In a seven-page response to the plaintiff’s allegations filed Tuesday, Tyler’s attorneys argue that the plaintiff “suffered no injury or loss as a result of any act or omission of (Tyler)” and that the plaintiff did not is entitled to compensation from the 75-year-old musician.

“Plaintiff’s claims are dismissed in whole or in part because (Tyler’s) actions were lawful, good faith, reasonable, non-discriminatory and/or non-retaliatory,” court documents from Tyler’s attorneys state, further claiming that the plaintiff’s claim for punitive damages violated his right to due process.

Tyler’s filing also alleges that the plaintiff’s claims are barred in whole or in part by her purported consent and that as her former guardian he had at least qualified immunity.

In her lawsuit, filed Dec. 27, prosecutor Julia Holcomb alleges that Tyler convinced her mother to give him custody of her when she was 16 so she could live with him and have a sexual relationship. She claims they have been together since 1973 for about three years.

The accuser became pregnant in 1975, making Tyler both the father of the accuser’s unborn child and her legal guardian, the lawsuit states, which further states that the Catholic accuser later gave in to pressure from Tyler and performed an abortion .

Prosecutors then “made a conscious decision to leave the music and drug-addicted world and escape to be free of the sexualized culture created by Tyler and the industry,” according to her lawsuit, in which she also finds that they ‘ become a family and active in their faith.
