In France, the labor code does not (yet) provide for specific measures for those who undergo a natural termination of pregnancy, previously called miscarriage. But some collective agreements take the initiative and offer exceptional leave for this situation.
Syntec signs an agreement for an exceptional leave in case of miscarriage
Syntec, which represents five professional organizations in the fields of digital technology, engineering, consultancy, events and professional training, signed an agreement on December 13, 2022 to allow people who undergo a natural termination of pregnancy before 22 weeks of amenorrhea to pose two daysnot deductible from paid holidays, paid and cumulative with any prescribed termination of work.
To do this, the employee simply needs to send a medical certificate to her employer within 15 days of the event.
Syntec follows the path of Critizr, an SME specializing in customer relations, which since 1um May 2022 had implemented a five-day leave for employees facing a natural abortion. This same company had also chosen to offer a menstrual leave for people with disabling menstrual pain.
Two days are still not many, but it is already a first step in recognizing the suffering that a miscarriage can cause in the persons concerned.
As a reminder, natural termination of pregnancy affects one in four pregnancies in the first quarter. 200,000 women go through this test every year in France. One in ten women is at risk of experiencing a natural termination of pregnancy during her lifetime.
