Kroy "KJ" Biermann Jr., the 15-year-old son of reality television star Kim Zolciak and former NFL player Kroy Biermann, has pled not guilty to seven felony charges, including aggravated child molestation and sexual battery involving a female classmate in Georgia.

Legal documents obtained by the Daily Mail show that the teenager entered his formal plea of not guilty in Fulton County Superior Court on Monday. His defense attorney, Jason Sheffield, filed the paperwork and officially waived his client's formal arraignment, which had been scheduled for next Wednesday.

Sheffield also requested that Fulton County court officials schedule a hearing date to consider transferring the case to Fulton County Juvenile Court. Both Sheffield and Zolciak declined to comment when contacted by the Daily Mail regarding the plea.

Felony Charges and Gym Incident

The plea comes after a Fulton County grand jury indicted the teenager on seven felony counts. The charges comprise one count of aggravated child molestation, one count of aggravated sexual battery, one count of aggravated sodomy, one count of false imprisonment, and three counts of sexual battery against a child under the age of 16.

Prosecutors allege that the incident involving the female classmate took place on April 23 at a Life Time fitness center in Alpharetta, Georgia. Alpharetta is a suburban city located in northern Fulton County, roughly 26 miles north of downtown Atlanta. Life Time operates athletic resort clubs featuring workout areas and sports facilities across North America.

If convicted of the felony charges, the teenager could face up to 25 years in a Georgia state prison. Fulton County Superior Court handles felony criminal prosecutions for adult offenses and serious juvenile charges, while juvenile courts process matters involving minors where rehabilitation rather than adult incarceration is prioritized.

Bond Conditions and Home Supervision

The 15-year-old was released from jail on a $200,000 bond over two weeks ago, according to reporting by TMZ. Fulton County Superior Court Judge Melynee Leftridge granted the release order in a Georgia court nearly a month after the teenager was taken into custody following his August 17 arrest. He spent almost four weeks behind bars prior to his release.

Under the terms of his bond, the teenager is residing in the full-time care of his mother, 48-year-old former Real Housewives of Atlanta star Kim Zolciak. Returning to live with Zolciak was a mandatory condition set by the court, despite previous police body camera footage in which the teenager referred to his mother as a "horrible example of a parent."

Judge Leftridge imposed strict supervision rules as part of the release conditions. The teenager is required to attend school virtually from home and is subject to continuous electronic monitoring by law enforcement authorities. He is strictly prohibited from using cellphones or accessing any social media platforms.

Prosecution Claims and Defense Response

During the bond hearing, Deputy District Attorney Caitlin McGillicuddy argued against lenient release conditions, describing the alleged April incident at the fitness center as "predatory." McGillicuddy told the court that the alleged victim suffered "documented physical injury" as a result of the encounter.

McGillicuddy also revealed in court that the teenager had previously been charged with sexual battery of a minor in October 2025, six months before the alleged April incident. She stated that the earlier matter was adjudicated in juvenile court and that the teenager remains under court supervision, which is scheduled to expire in 2027.

Defense attorney Jason Sheffield strongly contested the prosecutor's characterization of his client's past. In a statement provided to the Daily Mail, Sheffield stated: "The characterizations made in court regarding the prior juvenile matter involving KJ Biermann grossly misrepresent both the facts and the ultimate resolution of that case."

Sheffield elaborated on the previous incident, clarifying: "The matter arose from inappropriate, crude behavior involving two middle-schoolers. It did not result in an adjudication for statutory rape, sexual intercourse, or any comparable offense. Any suggestion otherwise is inaccurate and creates a materially misleading impression of how the juvenile matter was ultimately resolved."

Addressing the current allegations, Sheffield told the judge during the bond hearing: "This has been so traumatizing to [KJ] personally. He is not a boisterous kid. He is somewhat quiet."

Juvenile Court Transfer Request

Earlier this month, Sheffield filed a formal motion requesting that Fulton County Court transfer the entire case to Georgia's juvenile justice system. In the filing, Sheffield argued that the 15-year-old is young enough to benefit from rehabilitation programs provided by the juvenile court system rather than facing adult criminal trial proceedings.

Despite an ongoing and bitter separation, parents Kim Zolciak and Kroy Biermann both attended the bond hearing in Fulton County to show support for their son. Biermann, 41, is a former professional football player who spent eight seasons in the NFL as a defensive end and outside linebacker for the Atlanta Falcons after being drafted in 2008.

They split in 2023 after 12 years of marriage, launching a highly publicized and contentious divorce battle that remains unresolved in court.

An eyewitness inside the courtroom noted that the estranged parents put their differences aside to present a united front for their son. Zolciak remained "stone-faced" while sitting next to her 29-year-old daughter, Brielle, while Biermann appeared "stressed" throughout the legal proceedings.

Mother Defends Son and Cites Evidence

Following the court proceedings, Zolciak and her daughter Brielle left the courthouse without answering questions from reporters gathered outside. However, Zolciak had previously issued a public statement to the Daily Mail last month, breaking her silence to vigorously defend her son and maintain his innocence.

In that statement, Zolciak denounced the criminal charges as "reckless and deeply troubling," asserting that her son had done nothing wrong. She stated: "He categorically denies ever being involved with this woman or engaging in the conduct she has alleged."

Zolciak revealed that her son had taken investigative steps to clear his name, claiming: "My son voluntarily took a polygraph examination regarding these allegations and passed." She added: "Additionally, an examination was conducted, and no DNA belonging to my son was found."

Concluding her statement, Zolciak expressed full confidence in the judicial system. She said: "We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations."
