Franco Velazco, legal administrator of Universitario de Deportes, said the Peruvian football club will take legal action after Lima's 24th Administrative Court granted a precautionary measure in favor of Gremco Corp.
Universitario de Deportes, nicknamed "la crema," is one of Peru's most successful football clubs. The ruling provisionally lifts the suspension of the club's insolvency proceedings before Indecopi, opening the way for a new Creditors' Board meeting to be called. Velazco described the decision as absolutely irregular.
Opposition motion and criminal complaint
Velazco said the appropriate legal response was not a conventional appeal but a direct opposition motion aimed at overturning the ruling. He said the club would also pursue criminal proceedings against the judge who issued it, Edwin Bautista, questioning his fitness to remain in the judiciary.
Velazco said the club would file the opposition motion and lodge the criminal complaint against the judge, adding that there was enough evidence to question his conduct in the case.
In a video statement shared on social media, Velazco said the opposition would be filed the following day and that the club would report Judge Edwin. He also called on Ines Tello, president of Peru's Judiciary, to take note of the case.
Indecopi's role in the case
Velazco said Indecopi, Peru's national institute for the defense of competition and protection of intellectual property, would be required to formally join the proceedings, since the agency is the main defendant over its earlier resolutions in the case. Indecopi also oversees corporate insolvency proceedings of the kind affecting Universitario.
Club says operations unaffected for now
Velazco sought to reassure fans and club employees, saying the precautionary measure was strictly provisional. He said it did not give immediate authority to replace Universitario's current administration or change the team's day-to-day operations.
He said any move to convene a new Creditors' Board would take time, requiring at least 20 business days following a series of mandatory official publications. Velazco said the club was confident it could get the precautionary measure lifted before those deadlines were reached.
