How to swear in a beauty salon? Advice from a lawyer and salon owners

She asked him to cut the tips and returned home with a hat; he said he wanted ash yellow, but it turned out yellow; brows were asked to leave their natural shape and saw “strings” in the mirror – all of this we (and I’m sure many of us) have experienced more than once. At this time the reaction is different – some want to cry, others are unable to restrain the aggression, and yet others are in shock. Any feelings are normal, but you can’t get away from them, so you need to get together and take matters into your own hands.

Cursing properly at a beauty salon is an art that needs to be learned. What do we mean by “correct”? That is, to defend their rights and seek compensation for their damage.

Our teachers today will be lawyer Maxim Andreev and the owners of beauty salons: Aida Vulfova (founder of AIDA salon) and Elena Temirgalieva (founder of MilFey beauty salons). We looked at the most common situations that can happen to you at the gym and asked the experts to tell you what you need to do to come out of them as a winner, not a loser.

If the service in the salon is not satisfactory, which law is applied?

“All the shortcomings in the work of salons” fall into the law “On the Protection of Consumer Rights,” says lawyer Maxim Andreev. – That is, in accordance with Article 29 of the Federal Law “:

“The consumer has the right to demand the following at his own discretion, upon detection of deficiencies in the work (service provided):

– elimination of the deficiencies of the work performed (service provided);

– a corresponding discount on the price of work performed (service rendered);

– the free production or remake of something other than a homogeneous material of the same quality. In this case, the consumer, what the contractor has previously transferred to him;

– reimbursement of expenses incurred by him or by third parties to correct the deficiencies of the work (service provided).

If someone threatens to call the police, you should know that he or she has no right to interfere in civil relations.

If the service does not comply with the declared service, you can request correction of defects, reduction of service cost, refusing payment or refund.

This is done in free written form with a detailed explanation of the conditions.

Now let’s move on to specific situations.

lawyer’s opinion: In such cases, the person should not pay for the work done. Any salon that respects its clientele should offer a free service to make up for the visitor’s frustration.

View of Aida Vulfova, founders of the AIDA salon: If a person does not like a haircut, they will be offended by it, we will redo it at our own expense. A satisfied and happy customer means referrals, good reviews and ultimately the profit of the business.

lawyer’s opinion: Properly handled tools no longer pose any danger. Even if a cut was made with sterile instruments, it is not dangerous in this case, since the possibility of infection is eliminated. According to SanPiN 2.1.2.2631-10, manicure instruments must be processed in three stages: disinfection, pre-sterilization treatment, sterilization.

Opinion of Elena TemirgalievaThe founders of MilFay beauty salons: We are ready not to receive payment for services rendered that do not satisfy the client, and also to compensate with interest, gifts, cash deductions for the deposit.

lawyer’s opinion: Any procedure in a beauty salon should begin with a detailed description of what the master will do exactly, in what order and for what purpose. The master should warn you of all possible risks, indicate the approximate duration and cost of the procedure, and also discuss with you an action plan if he suspects in advance that the result may not be what you expected. If the coloring was not as you initially discussed, the salon should correct the shortcomings of the service provided – redo the coloring.

lawyer’s opinion: Ideally, you need to fix this fact in a medical institution, it is important to establish causal relationships, and then write a request to the salon. If they are not satisfied, they apply to the court for the protection of their rights.

lawyer’s opinion: If the defect in service manifests itself after visiting the institution, you should go to the doctor and then attach a quote from your medical history to the claim.

View of Aida Vulfova: If a client requires a service that is clearly contraindicated for them, we either politely decline or sign an informed consent before it is provided (even at a hair salon). This allows you to immediately minimize risks.

lawyer’s opinion: Ask the master not to style the hair at the end of the haircut, blow the strands with a hairdryer, comb or straighten them with your fingers. This will give you a better idea of the quality of the cut.

Opinion of Elena Temirgalieva: If the client is not satisfied and we cannot correct the result, payment for their services will not be accepted in our salons. However, you must understand that the customer may not be satisfied for objective and subjective reasons, but there is a category of customers who deal with “consumer terrorism”. If it’s just him, we blacklist that client. But even in this case, the visit of a dissatisfied customer will be at the expense of the salon.

lawyer’s opinion: In the Civil Code of the Russian Federation there is the concept of an offer, that is, a documented offer. The price is a public offer and the seller is obliged to sell the goods (in our case, to provide a service) to the buyer at the price specified in the offer. The customer, who finds himself in such a situation, should contact the salon manager and report this situation to him and demand the correction of the illegalities. If the dispute is not resolved, the client has the right to apply to the territorial body of Rospotrebnadzor with a statement of violation of rights (it is recommended to attach a photo of the price list and receipt).

So the main law you need to know is the Consumer Protection Law. You can request that deficiencies be corrected, the cost of the service reduced, refuse payment, or request a refund for the service. If you are faced with one of the above situations, do not hesitate to resort to the law!
